Update in case after man claimed he couldn’t sue Disney for wife’s death as he had Disney+ account

A man who sued Disney over his wife's death at one of their parks has voluntarily dismissed his claim against the entertainment giant.

Jeffrey Piccolo had been suing Disney for damages of $50,000 after his wife Dr Kanokporn Tangsuan died in 2023 after suffering an allergic reaction in Disney World Orlando.

However, Piccolo voluntarily dismissed his claim against Disney on 27 February this year, with his legal representative Brian Denney telling Florida Politics: "I have no comment other than this matter has been resolved."

They reported that court records did not indicate whether a settlement had been reached in the case.

While Piccolo accused Disney and Raglan Road of negligence in his lawsuit saying it was 'totally preventable' if 'proper protocols' had been followed, in 2024 Disney tried to argue that he couldn't get a jury trial because of terms he agreed to when getting a free trial of Disney+ in 2019.

Lawyers representing Disney tried to argue that signing up to Disney+ meant Piccolo had agreed to terms and conditions saying he'd handle any dispute he had with them through arbitration.

Disney dropped this argument later on in 2024 after public backlash.

Dr Tangsuan had eaten at the Raglan Road Irish Pub and Restaurant on 5 October, 2023 alongside her husband and mother, and according to Piccolo's claim they'd told staff at the restaurant about her allergies several times and been reassured they could get allergen-free food if they asked for it.

The 42-year-old doctor had serious allergies to nuts and dairy and ordered the 'Sure I’m Frittered', 'Scallop Forest', 'This Shepherd Went Vegan' and 'Onion Rings'.

When it arrived some of the food came without allergen-free flags and when they asked if what they'd been served was safe to eat they were told again it was.

After leaving the restaurant the couple went their separate ways at around 8pm that evening as Piccolo returned to their hotel room while the doctor stayed out shopping.

Around 45 minutes later she started having difficulty breathing and collapsed.

She administered her EpiPen and someone called an ambulance to take her to hospital but she died, with her cause of death given as a severe allergic reaction and an accident.

While legal proceedings were ongoing Disney had said Raglan Road was an 'independently owned restaurant located in Disney Springs' and their connection to it was that of 'landlord and tenant'.

A spokesperson for Disney had previously said they were 'deeply saddened by the family’s loss and understand their grief', but since they didn't own the restaurant they were 'merely defending ourselves against the plaintiff’s attorney’s attempt to include us in their lawsuit against the restaurant'.
