Why Bianca Censori won't be facing any punishment for X-rated Grammys outfit

Why Bianca Censori won't be facing any punishment for X-rated Grammys outfit

Some people have suggested Kanye West's wife should face the slammer for her bold outfit choice at the Grammys

Although the fashion police might still be after her, Bianca Censori won't face any legal consequences for her controversial outfit at the Grammys.

A lot of people were left wondering whether the Australian model would be punished by the law for essentially turning up to the awards show in her birthday suit.

She stunned fans after strutting down the red carpet with her husband Kanye West on Sunday (2 February), before dropping her feather coat to reveal a transparent mini-dress.

The world was given a window into every crevice of Censori's body thanks to the couture get up which was custom-designed for her, according to the rapper.

It was a first for the Grammys red carpet, that's for sure - but was the 30-year-old's stunt even legal?

As we all know, people walking around starkers run the risk of being bundled into the back of a police car and arrested for indecent exposure.

In the UK, the crime - which is also dubbed 'flashing' - carries a custodial sentence of up to two years, according to Old Bailey Solicitors.

Indecent exposure is defined as 'someone deliberately exposing their genitals in order to frighten or upset someone else', police on our side of the pond say.

Although we can't speak on Censori's motivations for wearing the sheer mini-dress, a lot of social media users believed she should have been arrested for her Grammys stunt.

Taking to X, one person said: "I don't understand why she hasn't been arrested. It's indecent exposure."

Another wrote: "If a man did what Bianca Censori did, he’d be in [prison] for public indecency."

A third added: "Many a flasher have been arrested. She is no better. Arrest should be made."

While a fourth wrote: "Bianca is fully naked and there are children present? Is this not a felony? I hate to be that person, but imagine if it was a man?"

And a fifth chimed in: "Have the cops just decided that Bianca Censori has full immunity to walking around fully naked? I mean, I’ve got no problem with it. But it’s f***ing crazy."

Rest assured, Censori hasn't been given a special pass which allows her to waltz around wherever she likes without a stitch on.

The California Penal Code 314 (1) defines indecent exposure as 'when a person exposes his or her naked body or genitals in front of anyone who could be annoyed or offended by it'.

The Penal Code clarifies that this can take behind closed doors, in public and 'in just about any environment'...so that includes red carpets, I guess.

It continues to explain that the exposure must be 'willful and lewd', while the perpetrator must also tick a few other boxes in order to be found guilty under California law.

You must 'intentionally expose your genitals or naked body; expose yourself in front of someone who might be offended or annoyed by it; intend to direct attention to yourself; and intend to sexually gratify yourself or offend someone else when you do it'.

However, the Los Angeles Police Department (LAPD) didn't receive any formal complaints about Censori's state of undress, according to TMZ.

The news outlet reported that sources in the force explained as the Grammys are a private event and 'no one from the award show contacted police with any complaints about how Bianca was dressed', Censori is in the clear.

Los Angeles-based lawyer Andrea Oguntula, told Page Six: "While Ms. Censori’s outfit undoubtedly pushed the envelope, a charge of indecent exposure in California requires willful public exposure of one’s genitals with the specific intent to offend or sexually arouse."

"It’s theoretically possible, but unlikely she’ll face any criminal prosecution for this incident," she added, explaining that it's the district attorney’s call.

LADbible has contacted the LAPD, Censori and representatives for West for comment.

Most shocking moments in Grammys history

From dazzling performances and emotional tributes to scandalous statements, let's take a look back at some of the most jaw-dropping moments from the awards show.

It's hard enough playing one piano in front of a huge audience, let alone two, but 'Girl on Fire' singer Alicia Keys blew fans away back in 2019 when she took to the stage for an iconic dual-piano performance.

The singer paid homage to jazz star Hazel Scott with her impressive display as she performed a medley of songs she 'wished she'd wrote'.

"I always wanted to play two pianos," she simply said at the time. And that she did. Fair play!

Back in 2011 Lady Gaga was still well into her era of wacky red carpet attire and theatrical performances, but she really pushed the boat out when she turned up to the awards ceremony in a literal egg.

To top it off, she emerged sporting a yolk-coloured bra and matching yellow skirt.

Annie Lennox turns up in drag

Back in 1984, Grammys staff were scrambling around in a state of sheer panic looking for Eurythmics star Annie Lennox who was set to perform the group's hit 'Sweet Dreams (Are Made of This)'.

Turns out however, she was simply in drag, and staff had no clue it was her. And neither did the audience, who were suitably confused when she stepped onto the stage to perform the iconic track.

"People were unaware that it was me, so it was almost like being a fly on the wall for a while," she said at the time.

The move was essentially done as a two fingers to people questioning her sexuality and androgynous style.

Elton John and Eminem become the duo no one expected

In 2001, Slim Shady was at the peak of his fame, having cemented himself as one of the most successful - and controversial - rappers of the time. But it's safe to say no one was expecting him to duet with music legend Elton John, especially given the nature of some of Eminem's lyrics.

At the time, it was reported that several LGBTQ+ advocacy groups were far from happy with the move.

Whitney Houston was tragically found dead in her hotel room just one day before the 2012 Grammys, with Jennifer Hudson stepping in last minute to perform a memorable tribute to the star.

The music industry and wider entertainment world was still reeling from the heartbreaking news as Hudson belted out Houston's iconic song 'I Will Always Love You'. She received a standing ovation from the crowd following the emotional performance.

Nicki Minaj gets exorcised

In 2012, rapper Nicki Minaj majorly p**sed off the Catholic church when she strutted down the red carpet arm in arm with a fake priest before putting on an 'exorcism' during a performance of her track 'Roman Holiday'.

Jaws dropped as the star began levitating while hooked up to various cables.

In response to the backlash, Minaj said she 'didn't know what the big issue was'.

Queen Latifah officiates 33 marriages on stage

In 2014, Macklemore's track 'Same Love' began ringing out of the Grammys stage when towards the end out of nowhere, 33 same-sex and straight couples lined up on stage to get married with Queen Latifah ordaining.

Oh, and to make matters even more iconic, Madonna then steps out to sing her hit 'Open Your Heart', prompting a second wave of cheers to erupt from the crowd.

"This song is a love song, not for some of us, but for all of us," Queen Latifah said at the time.

Doja Cat nearly misses her award... because she was on the bog

That's right, Doja Cat had nipped to the loo when it was announced she and SZA had won best pop duo for their song 'Kiss Me More' at the 2022 Grammys. Typical.

Safe to say the star looked flustered as she finally joined SZA on stage to accept the award, joking that she'd never used the toilet so quickly 'in my whole life'.
